I'm listening to Yo-Yo Ma and friends play a stirring arrangement of Copeland on the Capitol steps... and I look at the clock and realize we don't have a President. Article 20 says the President's term ends at noon. It's 12:03 Eastern Time, and Barack Hussein Obama still hasn't sworn the oath. Imagine that—for one brief moment, America has no President.
I'm told for that three minutes, Joe B. was the president. True?
ReplyDeleteCNN said that the Constitution makes him president at noon whether he swears the oath or not.
ReplyDeleteArticle II: Section 1: "...Before he enter on the Execution of his Office, he shall take the following Oath or Affirmation...."
ReplyDeleteWhether or not that 3-minute interlude was actually anarchic, I find it fascinating that you refer to it as a "shining moment"!
ReplyDeleteStan, in high school, I ran for student body president quoting Thoreau and promising that I would abolish the student council and see student activities run entirely by ad hoc volunteer groups. That high school anarcho-pacifist still has a voice in my inner political debates.
ReplyDeleteThe channel I was watching featured commentators that indicated Obama became president at noon regardless of whether he had taken the oath.
